Teacher Training Liability Release Form EVENT:
Harmony Yoga Teacher Training Program For and in consideration of being permitted to practice yoga at, or otherwise allowed to enter any area where any activity related to the program described above (The Event) shall take place, or being permitted to observe or otherwise participate in or be involved with any purpose related to the Event, I, the undersigned, for myself, my personal representatives, heirs, next-of-kin, assigns and insurers, unconditionally and voluntarily release, waive, discharge, covenant not to sue, and agree to indemnify and hold harmless, Harmony Yoga Inc and its present, former, and future parents, subsidiaries and affiliated companies, and their respective employees, directors, representatives, agents, contractors and officers (collectively, Harmony Yoga), from any and all claims, damages, losses or liabilities (including, without limitation, death, personal injury, property damage, or other loss) which may accrue as a result of my participation in the Event. I UNDERSTAND THAT THIS DOCUMENT IS INTENDED TO DISCHARGE HARMONY YOGA FROM AND AGAINST ANY AND ALL LIABILITY ARISING OUT OF, OR RELATED IN ANY WAY WITH MY PARTICIPATION IN THE EVENT, EVEN IF THAT LIABILITY IS CAUSED BY HARMONY YOGA CONDUCT. I understand that serious accidents may occur during yoga activities and that participants can sustain fatal and/or serious personal injury. Notwithstanding this, I hereby agree to assume full and complete responsibility for, and risk of, bodily injury, death, property damage or any other kind of injury or damage, whether foreseen or unforeseen, which may occur during my participation in the Event. I UNDERSTAND THAT MY $500 DEPOSIT IS NON-REFUNDABLE AND NON-TRANSFERABLE. MY $500 DEPOSIT SECURES MY SPOT IN THE EVENT, AND WILL BE RETURNED IF MY APPLICATION IS NOT ACCEPTED. I ALSO UNDERSTAND THAT THE FULL COST OF THE PROGRAM IS NON-REFUNDABLE AND NON-TRANSFERABLE WITHIN 31 DAYS BEFORE THE PROGRAM BEGINS. NO EXCEPTIONS. I understand that if I miss any lectures, I must make up the sections in an upcoming Program. If I miss more than 20 hours of the 200 Hour program, and I’m unable to make all delinquent hours up in one upcoming Training Program, an extra administration fee of $500 will be required for every subsequent program that I must join. If I miss any more than 20 hours of the Event, I am responsible for paying the increase in the cost of the Program, even if full payment has previously been made. Harmony Yoga reserves the right to deny my certificate if I don’t uphold the requirements of the Program, attend ALL lectures, and complete all the work required. Harmony Yoga reserves the right to deny participation in the Event at any time to individuals demonstrating behavior that any result in injury to themselves or others. I acknowledge that Harmony Yoga or its vendors at this Event may take photographs, or videos and recordings of me. I agree that any such photographs, videos, recordings or quotes, along with my name and biographical information, may be used by Harmony Yoga in any manner, venue or media worldwide in perpetuity, without compensation, for any lawful purpose, including without limitation for marketing and trade purposes. I acknowledge that any voice or video recording that I make during the course of the Event are for my eyes and ears only. Under no circumstance will I share this information with anyone outside of the Event, and I acknowledge that I will never publish the recordings or the content anywhere, indefinitely beyond the conclusion of the Event. In consideration of permission to participate in the Event, I CONTRACTUALLY AGREE that ALL CLAIMS herein shall be GOVERNED BY CALIFORNIA LAW AND ALL LITIGATION RELATED IN ANY WAY TO THIS RELEASE SHALL ONLY BE BROUGHT IN A STATE OR FEDERAL COURT OF COMPETENT JURISDICTION IN CALIFORNIA. I agree that the foregoing terms are intended to be as BROAD AND INCLUSIVE AS PERMITTED BY LAW. These terms shall continue from this date forever. If any portion of this document is found invalid, unenforceable, or contrary to public policy, law, statute, or ordinance, then the remainder of this document shall remain valid and fully enforceable. This document embodies the entire agreement and supersedes any previous or contemporaneous statements, negotiations or agreements regarding the Event. I agree that no representations, warranties, agreements, promises or inducements have been made by Harmony Yoga or anyone on behalf of Harmony Yoga, except as set forth herein. I understand that by participating in the event and providing the below information, I am agreeing to receive marketing communications, including email, postal mail and telephone calls, from Harmony Yoga and its authorized dealers, as well as follow-up emails about the event. I understand that I can opt-out of receiving marketing communications from Harmony Yoga and its authorized dealers at any time after receiving such communication. I acknowledge, agree, represent, and warrant that I am 18 years of age or older. I HAVE CAREFULLY REVIEWED THIS DOCUMENT AND I UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A WAIVER, RELEASE OF LIABILITY, AGREEMENT OF TERMS, AND COVENANT NOT TO SUE.
